Foxtel Package Promotion Terms and Conditions: Promoter: Foxtel Management Pty Ltd A.B.N. 65 068 671 938 on behalf of the Foxtel Partnership (Foxtel) of 1-21 Dean Street, Moonee Ponds, Victoria 3039. Ph: (03) 8325 2222. Foxtel intends to operate and administer a promotion on the following terms and conditions (Foxtel Package Promotion): 1. The Foxtel Package Promotion will commence at 9.00am Australian Eastern Standard Time (AEST) on 5 October 2018 and end at 5.00pm AEST on 30 November 2018 (inclusive) (Foxtel Package Promotional Period). 2. During the Foxtel Package Promotional Period, a person (Eligible Customer) that: (a) is an Australian resident over the age of 18 years; and (b) purchases a television which is specifically marked as “Foxtel Package” Promotion television (Eligible Television) from a Harvey Norman®, Domayne® or Joyce Mayne® AV/IT Franchisee (Physical Franchisee) or from the franchisees operating the websites www.harveynorman.com.au, www.domayne.com.au and www.joycemayne.com.au (Online Franchisee) (each a Participating Franchisee); and (c) provides the following details of the Eligible Customer (Eligible Customer Information) to Foxtel via a website owned and operated by Foxtel (Portal): (i) first and last name; (ii) contact telephone number (Contact Number); (iii) details of whether the Eligible Customer is a new or existing Foxtel TV service subscriber; (iv) preferred date and time for a Foxtel representative to contact the Eligible Customer for the purposes of Foxtel providing that Eligible Customer with their Foxtel Package (Contact Time); and (v) express consent for their personal information to be provided to Foxtel to administer the Foxtel Package Promotion; will be eligible to acquire a Foxtel Package (defined below) offered by Foxtel as part of the Foxtel Package Promotion. 3. The Foxtel Package Promotion is open only to an Eligible Customer. 4. Each employee of Foxtel or Harvey Norman Holdings Limited (HNHL) or a subsidiary of HNHL or a Participating Franchisee, or any immediate family member of such employee is ineligible to acquire a Foxtel Package as part of the Foxtel Package Promotion. 5. Once an Eligible Customer has inserted the Eligible Customer Information into the Portal, the Eligible Customer will: (a) receive a call from a representative of Foxtel at the Contact Time on the Contact Number to organise a time and date for a Foxtel installation representative to visit the address provided by the Eligible Customer where the Foxtel Package will be installed (Eligible Customer Address) (Foxtel Representative Contact); and (b) if the Eligible Customer wishes, enter into a contract of supply and installation with Foxtel pursuant to the Foxtel Installation Terms and Conditions, available here https://www.foxtel.com.au/content/dam/foxtel/support/pdf/foxtel-rsta.pdf (Installation Contract). 6. The Eligible Customer acknowledges and agrees that the Installation Contract is between Foxtel and the Eligible Customer, and no Participating Franchisee, HNHL or any subsidiary of HNHL is a party to the Installation Contract. 7. Each Participating Franchisee, HNHL and each related body corporate of HNHL is not a promoter of the Foxtel Package Promotion. 8. For the purposes of the Foxtel Package Promotion, a Foxtel Package includes either: (a) Foxtel Package 1: Where an Eligible Customer purchases an Eligible Television from a Participating Franchisee, and that Eligible Customer does not have a current subscription to Foxtel TV services, the Foxtel Package will include: (i) a one (1) month subscription to the Platinum HD tier television package at no cost; (ii) an iQ4K box and equipment (iQ4K) at no cost; (iii) free installation of the iQ4K; and (iv) a six (6) month subscription to the Foxtel TV service charged by Foxtel to the Eligible Customer at Foxtel's normal rates and charges, which will be a minimum cost of $695.03 if the Eligible Customer nominates to pay Foxtel via direct debit. (b) Foxtel Package 2: (i) Where an Eligible Customer purchases an Eligible Television from a Participating Franchisee, and that Eligible Customer already has a current HD subscription to Foxtel TV services, the Foxtel Package will include free installation of a second set top box (for multi-room HD viewing) and one month HD subscription for this second set top box at no cost (thereafter each additional month will be charged by Foxtel at Foxtel's normal rates and charges). 9. Each Eligible Customer is limited to one (1) Foxtel Package per purchase of an Eligible Television. 10. Once an Eligible Customer nominates that they are either a new or existing Foxtel service subscriber on the Portal, that selection cannot be changed by the Eligible Customer. 11. Foxtel may, in whole or in part and subject to law, subcontract the installation of the Foxtel Package under the Installation Contract (Foxtel Subcontractors). Foxtel is responsible for the suitability and performance of the Foxtel Subcontractors. 12. Foxtel will supply and install a Foxtel Package at the Eligible Customer Address (at no additional cost to the Eligible Customer) within thirty (30) days after the date on which Foxtel makes the Foxtel Representative Contact, except in cases of force majeure and/or where the Eligible Customer Address is a rural or remote area of Australia, in which case the supply and install of a Foxtel Package by Foxtel will be as soon as practicable. 13. A Foxtel Package can only be supplied and installed in Australia. 14. Foxtel and some services are not available to all homes. iQ4 is available to satellite customers only. 15. To view a 4K channel requires an iQ4 set-top box, compatible HDMI cable and compatible 4K TV. Any other connected equipment connected to the iQ4 must also be compatible with Foxtel’s 4K UHD Standard. For more info see foxtel.com.au/compatibility. 16. The installation is a single standard technician installation only. Additional installations costs may be incurred for non-standard installations. 17. If the total stock of any of the products included in a Foxtel Package is not available (for whatever reason) during the Foxtel Package Promotional Period, Foxtel reserves the right to provide an Eligible Customer with an alternative replacement product that is of equal quality and value to fulfil the Foxtel Package (Replacement Products). If the Eligible Customer is not satisfied with the Replacement Products, Foxtel will use its best endeavours to source the correct products as soon as practicable to fulfil the Foxtel Package. Eligible Customers will not be entitled to any additional compensation from Foxtel in the event that the correct products cannot be sourced by Foxtel and Replacement Products are included in the Foxtel Package instead. 18. Eligible Customers must contact the relevant Participating Franchisee if they believe there has been an error in the purchase of an Eligible Television. 19. The rights of an Eligible Customer to acquire a Foxtel Package as part of the Foxtel Package Promotion (Rights) are not transferable and can only be claimed or redeemed from Foxtel by that Eligible Customer during the Foxtel Package Promotional Period. The Rights cannot be exchanged or redeemed for cash or in any other manner, in whole or in part. 20. The Rights cannot be exercised by an Eligible Customer in conjunction with any other offer by Foxtel. The Foxtel Package is non-transferrable, not redeemable for cash. 21. The Eligible Customer Information collected by Foxtel is for the sole purpose of administering the Foxtel Package Promotion, and the supply and installation of a Foxtel Package pursuant to these Terms and Conditions. Each Eligible Customer consents to the Eligible Customer Information being shared by Foxtel with Foxtel Subcontractors solely for the purpose of the supply and installation of the Foxtel Packages pursuant to the Installation Contract. 22. A copy of Foxtel’s privacy policy can be obtained at https://www.foxtel.com.au/about/privacy.html. 23. The laws of New South Wales apply to the Foxtel Package Promotion. Each Eligible Customer unconditionally submits to the jurisdiction of the courts of New South Wales.
